A domain name cannot be transferred from this website without your prior consent to agree to our terms and conditions.
2. UNAUTHORIZED USE
Without limitation, the following are not included in the domain sale: We cannot and do not check to see whether the domain name(s) you select, or the use you make of the domain name(s), or other of the Service(s), infringes legal rights of others. It is your responsibility to know whether or not the domain name(s) you select or use infringes legal rights of others. You could be ordered by a court to cancel, modify, or transfer your domain name; it is your responsibility to list accurate contact information in association with your account and to communicate with litigants, potential litigants, and governmental authorities. ExactMatchDomainName.com accepts no responsibility for trade-name infringements, or the like, alleged, or otherwise, once a domain name has passed ownership from ourselves. Trademarks (or brand names) indicate commercial source. As with patents, one can infringe on another’s tradenames without copying them or even being in direct competition with their owner. All that is necessary is to use the same or a similar name under circumstances in which consumers may be confused as to the source or sponsorship of the goods or services.
Upon purchase of any Domain Name from ExactMatchDomainName.com, please be aware that, as a part of our ongoing anti-fraud measures, we will retain the domain in our domain holding account for a period of 60 days. The domain will then be pushed to the account of your choosing.
Your domain will be considered your property by ourselves, and we will administer your wishes, as required, updating nameservers, contact info, and any other normal adjustments. Should your domain renewal occur within that 60 day period, we will request the renewal fee from you
Your purchase of any domain, constitutes ownership of said domain name, and is subject to the Internet Corporation of Assigned Names and Numbers (“ICANN”), the registries, and global governments. You will agree to the Uniform Domain Name Dispute Resolution Policy (“UDRP”), a copy of which is available athttp://www.icann.org/udrp/udrp-rules-24oct99.htm and http://www.icann.org/dndr/udrp/policy.htm.
It is your responsibility to ensure that your domain names are renewed promptly, and any renewal fees will become your responsibility, once the domain name is in your possession. ExactMatchDomainName.com assumes no responsibility for renewal fees on any domain names, not under our ownership. It is your responsibility to check the cost of renewal fees, before purchasing any domain name from ExactMatchDomainName.com. Renewal fees vary for different extensions, and may only be payable through specialist registrars, for example, a .pro is generally more expensive to renew than a .com.
5. DOMAIN REFUND POLICY
Since our company is offering non-tangible irrevocable goods we do not issue refunds after the domain is pushed to your account, for which you are responsible for understanding upon purchasing any domain names from our site. Please ensure that the domain you purchase is fit for purpose, and use your due diligence before buying, as once the domain leaves our account, we have no control its use, or ownership. All fees are due immediately and all fees are non-refundable, in whole or in part, even if your domain name registration is suspended, cancelled or transferred prior to the end of your current registration term, unless this agreement specifically provides for a refund.
6. ANTIFRAUD CHECK
Customer purchase can be suspended for manual antifraud check for 10-20 minutes as well as it can be suspended for longer term (around 20 hours) for more serious investigation. Antifraud check occurs because of growing number of fraud transactions from persons who are not actual cardholders of the credit cards used during purchase.
It remains your sole responsibility to ensure that you are eligible to hold any domain name in your possession. Certain registrars place restrictions upon ownership of certain extensions, including, but not limited to, professional qualification, country of residence and age of domain holders. Our company reserves the right to change or modify these terms with no prior notice.
8. ELLIGABILITY FOR .PRO
.Pro registrants no longer need to provide their professional credentials at the time of registration. Instead, EnCirca will be collecting the profession of the registrant. If selected for a random audit by the registry, registrants should be prepared to provide proof that they have been so recognized in a specified field or profession.
